Driving Under the Influence of Alcohol (DUI)
A minor commits an offense if he or she operates a motor vehicle in a public place while having any detectable amount of alcohol in the minor's system. DUI is a Class C Misdemeanor.
* A minor is anyone under 21 years of age.
Can a minor be arrested for DUI?
A minor who is aged 17 to 21 can be arrested for DUI and taken to the county jail. The minor will sit in jail until a magistrate sets their bond. Generally, however, if a parent or guardian can be located the law enforcement officer will not arrest the minor, but allow the parent to come and get the minor. The minor in that situation will be given a ticket and a summons for court.
